Terms of Service

These terms are an agreement between [Company name Ltd] ("we") and the business that signs up to Pawdiary ("you"). By creating an account you agree to them on behalf of your business.

The service

• Pawdiary is online software for running a grooming business: bookings, client and pet records, messages, payments and related tools.
• We aim to keep it available and working well, but we don't promise it will never be interrupted. We may change or improve features over time, and will give notice before removing anything significant you pay for.

Your account

• You must be at least 18 and able to act for your business. Keep your sign-in details safe and turn on two-step sign-in where you can. You're responsible for what happens under your account, including your staff's use.
• You must give accurate business details and keep them up to date.

Plans, trial and payment

• New businesses get a 14-day free trial with no card needed. After the trial, you move to the Free plan unless you choose a paid plan.
• Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices are shown in the app and include VAT where it applies. You can cancel any time; your plan continues to the end of the period you've paid for, and we don't give refunds for part-periods except where the law requires.
• If a payment fails, we will try again and let you know. If it still isn't paid, your business moves to the Free plan. Your data is kept.
• We may change prices with at least 30 days' notice. The change applies from your next billing period after the notice.
• Card payments you take from your own clients go through your own Stripe account, on Stripe's terms. We are not a party to those payments.

Your data

• Your business's data (including your clients' and their pets' details) belongs to you. You grant us the right to store and process it only to provide Pawdiary to you, as set out in our Data Processing Agreement, which forms part of these terms.
• You are responsible for having a lawful basis to keep your clients' data, for telling them how you use it, and for the messages you send them.
• You can export your data at any time from Settings > Account. If you delete your business, we delete its data within 30 days, apart from backups, which roll off within a further 30 days.

Acceptable use

• Don't use Pawdiary for anything unlawful, to send spam, to upload malicious code, to try to access other businesses' data, or to overload or reverse engineer the service.
• We may suspend an account that breaks these rules or puts the service or other users at risk, and will tell you why unless the law or security stops us.

Liability

• Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't be limited by law.
• Otherwise, we are not liable for indirect or consequential loss, or loss of profit, business or goodwill, and our total liability in any 12 months is limited to the fees you paid us in that period (or £100 if more).
• You are responsible for the grooming services you provide to your clients. Pawdiary is a tool for running your business; it is not a party to your agreements with your clients.

Ending the agreement

• You can close your business in Settings > Account at any time. We may end these terms with 30 days' notice, or straight away if you seriously break them.

General

• These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
• We will tell you about changes to these terms at least 30 days before they apply. Continuing to use Pawdiary after that means you accept them.
